“TEEN BEACH SUMMER VACATION” CONTEST (the “Contest”)
OFFICIAL RULES (the “Contest Rules”)
NO PURCHASE/PAYMENT OR TEXT MESSAGE NECESSARY.
THE CONTEST PERIOD
The Contest runs from 10:00 a.m. Eastern Time (“ET”) June 17, 2013 to 11:59 p.m. ET August 19, 2013 (the “Contest Period’”).
HOW TO ENTER
There are three (3) ways to enter the Contest:
Online Entry: To enter the Contest, go to www.family.ca and click on the “TEEN BEACH SUMMER VACATION" Contest icon displayed in the WIN IT section of the website to access the Contest microsite. Once you have opened the Contest microsite, select your answer via drop-down menu, to the question, “Name one of the cast members from “Teen Beach Movie”, then, click on the ENTER button to access the standard Contest entry form. Fill out the entry form by entering your full name, mailing address including postal code, age, phone number and e-mail address and submit. A completed on-line entry form will constitute one (1) entry into the Contest. Limit one (1) Online entry per person, per day.
SMS Text Entry: To enter the Contest via text message use your mobile phone (“Mobile”) to text the keyword “BEACH” as an SMS text message to the SMS shortcode 61010 (“SMS Entry”). SMS Entrants will receive a confirmation SMS text message on their Mobile from the Contest Sponsor. You must have a mobile phone that is capable of two-way text messaging and is registered with a Canadian Wireless Network. Digital and SMS service is required to enter by the SMS Text Entry method. Text messaging may not be available in all areas. Standard carrier-messaging and data charges may apply to each text message sent and received. Check your carrier plan for your standard text messaging and data fees which may apply to each text message sent and received. Contest Sponsor is not responsible for any mobile charges or fees of any kind. If you are a minor (as defined by your province or territory of primary residence, (a “Minor”) you must have the permission of your parent/legal guardian to enter via SMS Text Entry. There is a technical maximum limit of 12,000 SMS text entries that can be collected by Contest Sponsor for this Contest. Once the SMS Text Entry maximum limit has been reached you will no longer be able to enter the Contest by this method and will be prompted via SMS text message from the Contest Sponsor to alternatively submit your entry online or by mail-in entry. By entering via SMS Text Entry, you grant to Contest Sponsor your consent to call or text message your Mobile should you be selected a potential winner. Limit one (1) SMS Text entry per mobile number, per day.
Mail-in Entry: To enter the Contest by mail-in entry send us your full name, telephone number, province of residence, and age by mail. The entry will be entered on the day it is received, provided it is received within the Contest Period. Send entries to:

An entrant under the age of majority in his/her province or territory of residence must have a parent or legal guardian consent to his/her participation. Proof of identification and parental consent must be provided upon request. If a parent or legal guardian does not provide consent, or if satisfactory proof of identification to confirm the winner’s (or the winner’s parent, or legal guardian’s) identity and personal information provided in connection with the Contest, including but not limited to, the winner’s (or the winner’s parent, or legal guardian’s) name, mailing address, and email address, cannot be obtained, the entry will be disqualified. The contact information collected by The Family Channel Inc. (“FAMILY”) with your entry will only be used to award the Contest prizes. Family will keep your mobile number confidential and will not use your personal information for any other reason and will not otherwise disclose your personal information to any other party.
All Contest entries are eligible for both the Grand and Secondary prizes.
The Contest is open to permanent lawful residents of Canada only, excluding employees, representatives, and agents (and their immediate family members or persons with whom they are domiciled) of FAMILY (the "Contest Sponsor") and Best Western International, Inc. (the “Contest Co-Sponsor,” as described in further detail below), their respective affiliates and advertising and promotional agencies involved in this Contest. The Contest is open to persons who are between 8 and 18 years old and their parent/legal guardian throughout Canada, with the exception of Quebec where the Contest is open to persons between 13 and 18 years old and their parent/legal guardian. Entrants under the age of majority in his/her province of residence must have parent/legal guardian consent to participate. This Contest is subject to all Federal, Provincial, and Municipal laws and regulations. Void where prohibited by law. The Contest Sponsor with the consent of the Régie des alcools, des courses et des jeux, reserves the right to cancel or suspend this Contest in the event of any accident, or administrative or other error of any kind.
Entries must be received online, by post or text message no later than 11:59 PM ET on August 19, 2013. The Contest Sponsor takes no responsibility for entries that are lost, misdirected, delayed, or received after the Contest deadline. Only one (1) mobile phone account/email address/mailing address may be used by any person to enter the Contest, (regardless of whether one person has more than one Mobile phone and/or email address and/or mailing address, or more than one person use the same Mobile phone and/or email address and/or mailing address). In the event of a dispute as to the identity of a winner based on an e-mail address or mobile number, the Entry will be deemed to be submitted by the person in whose name the Mobile phone and/or email address is registered.
Limit one (1) entry per person/Mobile/Email address/Mail-in Entry, per day. In the event that FAMILY receives more than one (1) entry per person/Mobile/Email address/Mail-in Entry, per day, through any method of entry the Contest Sponsor reserves the right to void and destroy any entries from that entrant, and that entrant may, at the discretion of the Sponsor, be disqualified from the Contest. Should it be discovered that an entrant is using the aid of computer programs to auto-fill entries, that entrant will be immediately disqualified from the Contest. Contest Sponsor reserve the right to disqualify all such Contestant from future Contests conducted by the Contest Sponsor without further notice. By submitting an entry, entrants agree to be bound by these Contest Rules.
In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be deemed to be made by the authorized account holder of the e-mail address at the time of entry. The authorized account holder is the natural person who is assigned an e-mail address by an Internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question. Entries made via a mobile device will be deemed made by the authorized account holder of the mobile telephone number submitted at the time of entry. The authorized account holder" is defined as the natural person assigned to a mobile telephone number by a wireless carrier or other provider or organization that is responsible for assigning mobile telephone numbers. Potential winners may be required to show proof of being the authorized account holder for that mobile telephone number.
A random draw will be held at or around 12:00 PM ET on August 27, 2013 at FAMILY’s Toronto office located at 2 St. Clair Avenue West. There will be one (1) Grand Prize draw and five (5)) Secondary Prize draws to fulfill this Contest. The chances of being selected to win a prize in this Contest depend on the total number of eligible entries received.
There is one (1) Grand Prize Package available to be won (approximate retail value: UP to a Maximum of $10,000):
The Grand Prize Package consists of:
- A trip for the winner and three (3) guests for a beach vacation in the Los Angeles area,( as determined by the Contest Sponsor in their sole discretion) which includes:
- Four (4) roundtrip coach/economy class airfares from the major airport closest to the Grand prize winner’s residence and Los Angeles, California USA; and
- Two (2) Nights’ Standard Accommodation at a Best Western® brandedhotel to be determined by the Contest Sponsor and Contest Co-Sponsor in their sole discretion.
There are a total of five (5) Secondary Prizes to be won. Each Secondary Prize consists of:
i) $100.00 CAN Best Western Travel Card® which can be used at any Best Western branded hotels worldwide, towards the cost of your hotel stay.
The combined approximate retail value of the one (1) Grand Prize draw and five (5) Secondary Prizes is $10,500 CAN.
All amounts are in Canadian dollars.
The winner and his/her guests will be responsible for obtaining any required travel and health documents, including a valid passport (which must be valid prior to and for the entire duration of the trip), transportation to and from the departure airport or other departure location (ground transportation), gratuities, travel insurance incidentals and all other expenses not specifically mentioned above.
All costs and expenses not specifically included above as part of each Grand Prize including, without limitation, cancellation fees, taxes, departure taxes, other travel related taxes and fees, duties and levies, meals, telephone charges, other room charges, incidental expenses, medical expenses and other items of a personal nature, additional optional excursions, gratuities and insurance, souvenirs, parking, merchandise, are the sole responsibility of each Grand Prize Winner and his/her guest. The Grand Prize winners and guests may not seek reimbursement for any expenses from the Contest Sponsor or Contest Co-Sponsor. Lost or stolen tickets and travel vouchers will not be replaced. It is strongly recommended that the declared winner and his/her traveling companions purchase medical, accident and baggage insurance. The Contest Sponsor and Contest Co-Sponsor are not responsible in this respect. It is the responsibility of the declared winner and his/her travelling companion to check with the airline for baggage restrictions.
All travel is booked on behalf of the winners by the Contest Sponsor and Contest Co-Sponsor, is based on availability and some blackout periods may apply. The Grand Prize Winner and his/her three (3) guests must travel together from the same departure airport. The Grand Prize fulfillment will take place between August 31st, 2013 to August 31, 2014.
The Contest Sponsor and Contest Co-Sponsor make no representation or offers any warranty, express or implied, as to the quality or fitness of any Prize awarded in connection with the Contest. Prize winners understand and acknowledge that they may not seek reimbursement or pursue any legal or equitable remedy from the Contest Sponsor or Contest Co-Sponsor should a Prize fail to be fit for its purpose or are in any way unsatisfactory to a Prize winner.
If the actual value of any prize is less than the stated ARV, the difference will not be awarded.
If the winner is under the age of majority in his/her province or territory of residence, one (1) of the winner’s guests must be his/her parent or legal guardian who must be present at all times during the Grand Prize trip, and has agreed to be fully and legally responsible for the winner and his/her guests while they are participating in aspects of the Grand Prize.
WINNER NOTIFICATION & ACCEPTANCE OF PRIZE
Entrants selected as winners must correctly complete a mathematical skill testing question and must sign a declaration confirming compliance with the rules and regulations and acceptance of the prize as awarded, and a release form acknowledging the non-responsibility of the Contest Sponsor and Contest Co-Sponsor, their affiliates, members, subsidiaries, and/or associates and their respective agents, employees and officers and directors with regard to any injury, accident, damage, claim, liability, loss or misfortune related to any aspects of the Contest, prize, the acceptance, use, misuse, possession and delivery of the prize, printing errors, claims based upon publicity rights, defamation or invasion of privacy, prior to being awarded the Prize. If a winner is a minor, his/her parent or legal guardian must sign a declaration and release form on his/her behalf in order for the winner to claim his/her prize.
Selected entrants will be notified by telephone or e-mail, as applicable, within ten (10) days of the draw. Selected entrants will then have five (5) days following receipt thereof to contact FAMILY to claim their prize. Should FAMILY not receive confirmation within five (5) days, or should a selected entrant be unable to correctly answer the skill-testing question or complete the declaration and release by the date specified, selected entrant will be deemed to have forfeited any rights to the prize and a back-up entrant will be selected in the same manner by random draw taken from the same pool of entries, in which event, the foregoing provisions of this sentence shall also apply to such other eligible entry. All prize taxes, if any, are the responsibility of the winner. Limit one (1) prize per person/Mobile/Address.
The Contest Sponsor and Contest Co-Sponsor will not be held responsible for the loss of prizes due to changes in mailing addresses, errors in completed entry forms or any other circumstances leading to an invalid, erroneous or incomplete mailing address or e-mail address.
FAMILY or its appointed designee shall deliver prizes to winners. Delivery dates cannot be guaranteed.
Prizes must be accepted as awarded and may not be exactly as shown. The Contest Sponsor, in its sole discretion, reserves the right to substitute any portion of the Grand Prize Package or Secondary Prizes with a prize of equivalent or greater retail value. Some restrictions may apply. Prizes are non-transferable, non-refundable and have no cash value.
All entries become the property of FAMILY and will not be returned.
Each entrant agrees to waive all rights with respect to print and broadcast publicity. By entering the Contest and accepting a prize, the winner or parent or legal guardian of the winner hereby consents to the reasonable use by FAMILY of the winner's photograph, voice, likeness and/or image, contents of the entry form and the name and age of the winner, in connection with the Contest, worldwide and in perpetuity, for any future promotional activity, without any further compensation. Each entrant consents and agrees to FAMILY’s collection and use of the information provided by the entrant for the purpose of administering this Contest. Each entrant agrees to be bound by these Contest Rules.
The Contest Sponsor (and Contest Co-Sponsor) is not responsible for incorrect or inaccurate entry of registration or entry information which may affect an entrants’ inability to get through on the internet during the promotion or ability to participate in the Contest, including but not limited to human error, technical malfunctions, lost/delayed/corrupted data transmission, omission, interruption, deletion, defect, line failures of any telephone or mobile network, computer equipment, software or any combination thereof, any inability to access the site, telephone or mobile network, or damage to a user's system occasioned by participating in the Contest, and entries which fail to fully comply with these Contest Rules and Regulations.
The Contest Sponsor reserves the right, in its sole and absolute discretion, and with the consent of the Régie des alcools, des courses et des jeux, to cancel, modify or suspend a Contest for any reason, including without limitation in the event of any printing, administrative error, virus, bug, unauthorized human intervention or other causes beyond its control which corrupt or affect the administration, security, fairness or proper conduct of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Contest Sponsor (and Contest Co-Sponsor) reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are forged, falsified, altered or tampered with in any way. Appropriate notice to the Régie des alcools, des courses et des jeux will be provided where necessary. The Contest Sponsor (and Contest Co-Sponsor) is not responsible for preemption, cancellation, or interruption, in whole or in part, of any FAMILY Contest related programming.
For residents of Quebec, any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux (the "RACJ") for a ruling. Any litigation respecting the awarding of a prize may be submitted to the RACJ only for the purpose of helping the parties reach a settlement.
As discussed above, the Contest Co-Sponsor is Best Western International, Inc., 6201 North 24th Parkway, Phoenix, AZ 85016. However, FAMILY is solely responsible for the administration (e.g., registration, authorship of these Official Rules, collection of and retaining entrants’ contact information for the purpose of administering the Contest, conducting the drawing, etc.) of this Contest. Each Best Western® branded hotel is independently owned and operated. Best Western and the Best Western marks are service marks or registered service marks of Best Western International, Inc.
